The rules for using 4RGE, including accounts, bookings, payments, and how coaches and athletes work together.

These Terms and Conditions ("Terms") govern your use of the 4RGE mobile app and website (together, the "Service"), operated by 4RGE ("4RGE", "we", "us", or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Definitions

  • "Athlete" means a user who uses the Service to find and book coaching sessions.

  • "Coach" means a user who offers coaching sessions through the Service.

  • "Session" means a coaching session booked between an Athlete and a Coach through the Service.

  • "Content" means all text, images, logos and other material available through the Service.

2. Changes to These Terms

We may revise these Terms at any time. The revised version takes effect when posted to this page, and the effective date above will be updated. Continuing to use the Service after changes are posted means you accept the revised Terms.

3. What 4RGE Is

4RGE is a platform that connects Athletes with local Coaches. We help you find a Coach, book a Session, and pay in the app.

4RGE does not employ Coaches and does not provide coaching. Coaches are independent. Each Coach is responsible for the quality, safety and delivery of their own Sessions. We do not guarantee any Coach's qualifications, availability or results.

4. Accounts

You must be at least 18 years old to create an account. Where a minor trains with a Coach, a parent or legal guardian must create the account and book on their behalf.

You agree to provide accurate information and to keep your login details secure. You are responsible for all activity on your account. Tell us promptly if you think your account has been accessed without your permission.

5. Bookings and Payments

Booking a Session through the Service creates an arrangement between you and the Coach. Prices are set by Coaches and shown in the app before you book.

Payments are processed by our third-party payment provider, Stripe. We do not store your full card number. By paying, you also agree to Stripe's terms.

Cancellation and refund rules for a Session are shown at the time of booking. Where no rule is shown, contact us and we will help resolve the issue between you and the Coach.

6. Health and Safety

Physical training carries risk of injury. Before taking part in a Session, you should be in suitable health and, if you have any doubt, speak to a medical professional. You take part in Sessions at your own risk.

Content in the Service is general information only and is not medical or professional advice. If you have an emergency, call 911.

7. Conditions of Use

You agree not to:

  • Break any applicable law or regulation

  • Post content that is unlawful, harassing, threatening, or infringes the rights of others

  • Impersonate another person or misrepresent your qualifications or affiliation

  • Try to gain unauthorized access to the Service, its servers, or other users' accounts

  • Introduce malware or interfere with the normal operation of the Service

  • Scrape or collect data from the Service using automated tools without our written consent

  • Arrange or accept payment for Sessions outside the Service to avoid fees

We may suspend or end your access at any time, without notice, if we believe you have breached these Terms or are causing harm.

8. Intellectual Property

The Service and all Content are owned by 4RGE or its licensors and are protected by copyright, trademark and other laws. You may not copy, modify, distribute or sell any Content without our written permission. The 4RGE name and logo are our trademarks.

9. Your Content

If you upload a profile photo, review, message or other material ("Submission"), you give 4RGE a non-exclusive, royalty-free, worldwide licence to use, store and display it in order to run and promote the Service. You confirm that the Submission is yours and does not infringe anyone else's rights. We may remove any Submission at our discretion.

10. Third-Party Services

The Service relies on third parties such as Stripe, Apple, and hosting providers, and may link to other websites. We do not control these services and are not responsible for their content or practices.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use and share your personal information.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranty of any kind. We do not warrant that the Service will be uninterrupted or error free, or that any Coach or Session will meet your expectations. This does not affect any rights you have by law that cannot be excluded.

13. Limitation of Liability

To the fullest extent permitted by law, 4RGE and its directors, employees and agents are not liable for indirect, incidental, special or consequential damages, or for loss of profits or data, arising from your use of the Service. We are not liable for injury, loss or damage arising from a Session or from the actions of a Coach or another user.

Nothing in these Terms limits liability that cannot be limited by law.

14. Indemnification

You agree to indemnify and hold 4RGE and its affiliates harmless from claims, losses and expenses, including reasonable legal fees, that arise from your breach of these Terms or your misuse of the Service.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction over any dispute about these Terms or the Service.

16. General

If any part of these Terms is unenforceable, the rest stays in effect. These Terms and our Privacy Policy are the entire agreement between you and 4RGE about the Service.
